This Acceptable Use Policy (the “AUP”) governs your use of the CourtPulse software-as-a-service platform and related services (the “Service”) provided by CourtPulse LLC (“CourtPulse”). This AUP is incorporated into and forms part of the CourtPulse Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.
By using the Service, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your Account, with or without notice, in CourtPulse’s sole discretion.
The Service is licensed to licensed attorneys in good standing for use in connection with the attorney’s professional practice. Permitted use includes:
Monitoring cases on which you are an attorney of record;
Receiving Notifications about new filings on monitored cases;
Accessing court records that you are authorized to access through your own ECR System credentials; and
Sharing Notifications with your designated colleagues and staff (such as paralegals and co-counsel) through CourtPulse’s authorized notification features.
You agree that you will not, and will not permit any third party to, use the Service to:
Access, attempt to access, or monitor any case on which you are not an attorney of record or party;
Provide ECR Credentials to anyone who is not authorized to access the relevant cases under the rules of the Maricopa County Superior Court Clerk’s office or other applicable court records authority;
Circumvent or attempt to circumvent any access control, authentication, or restriction of the ECR System or of the Service;
Use ECR Credentials that were not issued to you or that you do not have the authority to use; or
Use the Service in any manner that violates the terms of use of the ECR System, the rules of the Maricopa County Superior Court, the orders of any court, or any rule of professional conduct applicable to attorneys in any jurisdiction in which you practice.
Share your CourtPulse Account credentials with any other person, including any other attorney, paralegal, staff member, or third party;
Permit any other person to use the Service under your Account; or
Use the Service under another person’s CourtPulse Account.
Disclose, publish, or otherwise distribute Court Records or Notifications to any person not authorized to access the underlying case;
Use the Service to track or surveil any person other than for legitimate legal-practice purposes related to a case on which you are counsel or party;
Use the Service or any Court Records accessed through the Service to engage in harassment, stalking, intimidation, or any other unlawful conduct;
Use the Service to compile, sell, or distribute databases of court records, party information, or case information for commercial resale, marketing, or any purpose not directly related to your professional representation of a client;
Reveal or disclose information from a sealed, confidential, or juvenile case, even if such information is inadvertently accessed through the Service; or
Use Court Records or Notifications in violation of any protective order, sealing order, or confidentiality order.
Attempt to gain unauthorized access to the Service, any other user’s Account, CourtPulse’s systems, or any third-party system;
Probe, scan, or test the vulnerability of the Service or any related system, except as expressly authorized by CourtPulse in writing;
Interfere with or disrupt the Service, the servers or networks hosting the Service, or the ECR System (including by introducing malware, denial-of-service attacks, or excessive load);
Use the Service or any portion of it to develop, train, or evaluate any competing product, service, or model;
Reverse engineer, decompile, disassemble, or attempt to derive the source code, underlying algorithms, structure, or organization of the Service, except as expressly permitted by applicable law that cannot be waived;
Remove, alter, or obscure any proprietary notice, copyright, trademark, or other marking on or within the Service; or
Use any automated means (other than the Service’s own authorized interfaces) to access, scrape, or extract data from the Service.
Use the Service in any manner that violates applicable law, including without limitation laws regarding privacy, data protection, intellectual property, computer fraud, or fraud;
Use the Service in violation of any rule of professional conduct, including without limitation rules regarding client confidentiality, conflicts of interest, candor toward the tribunal, and competent representation;
Use the Service to engage in any deceptive, fraudulent, or misleading conduct; or
Use the Service in any manner that exposes CourtPulse or any other user to legal liability or regulatory action.
Misrepresent your identity, your bar status, your role in any case, or your authorization to access the ECR System; or
Provide false or misleading information to CourtPulse, including in your Account registration or in any communication with CourtPulse.
You are solely responsible for all use of the Service under your Account, whether or not you authorized such use. You agree to monitor your Account activity and to report immediately to CourtPulse any unauthorized access or use.
You remain responsible for ensuring that your use of the Service complies with all rules of professional conduct, court rules, and ethical obligations applicable to your professional practice.
4.1 Investigation. CourtPulse may investigate suspected violations of this AUP. You agree to cooperate with any such investigation, including by providing information requested by CourtPulse and by preserving relevant records.
4.2 Suspension. CourtPulse may suspend your Account, in whole or in part, at any time and without prior notice, if CourtPulse reasonably suspects a violation of this AUP, the Terms of Service, the Court Terms, or applicable law, or if CourtPulse determines that suspension is necessary to protect the Service, other users, or third parties.
4.3 Termination. CourtPulse may terminate your Account upon a determination that you have violated this AUP. Termination decisions are at CourtPulse’s sole discretion. CourtPulse is not required to provide notice prior to termination.
4.4 No Refunds for Termination. If your Account is terminated for violation of this AUP, you are not entitled to any refund of fees paid.
4.5 Other Remedies. Termination of your Account is not CourtPulse’s exclusive remedy for violation of this AUP. CourtPulse reserves all other rights and remedies available at law or in equity, including without limitation the right to pursue injunctive relief, damages, and indemnification under Section 12 of the Terms of Service.
4.6 Cooperation with Authorities. CourtPulse may cooperate with law enforcement, court officials, bar disciplinary authorities, and other governmental authorities investigating suspected violations of law or professional conduct in connection with the Service. CourtPulse may disclose information about you and your use of the Service in response to valid legal process or in good-faith belief that disclosure is required by law or necessary to prevent harm.

We will review reports promptly. We may not be able to share the outcome of an investigation with the person who reported it.
CourtPulse may modify this AUP from time to time. The updated AUP will be posted at mycourtpulse.com with a revised Effective Date. Material changes will be communicated to you by email or in-app notice at least 30 days prior to taking effect. Your continued use of the Service after modifications take effect constitutes your acceptance of the modified AUP.
